    Abstract [en]

    Our Gardens of Justice special themed issue of the Australian Feminist Law Journal grew out of the 2012 Critical Legal Conference in Stockholm and its theme of Gardens of Justice, a conference organised  by Matilda  Arvidsson, Merima  Bruncevic, Leila Brannstrom and Leif Dahlberg. We issued a Call for Papers early in 2013 in which several conference theme questions were repeated. We called for papers devoted to thinking about law and justice as a physical as well as a social environment. The theme suggested a plurality of justice gardens that may function together but at times also may be at odds with each other. We invited authors to think freely and critically about both the concrete and the metaphorical garden, and invited articles that addressed questions of law and justice as spatial  and spatializing structures, as social topography and geography, as political cartography on a global scale, as places where symbolic orders and disorders become visible and may  be acted out, as mechanisms of inclusion and exclusion, as masculine and feminine and as social utopia. Later in 2013 we re-issued the Call for Papers emphasizing the metaphorical and the juridical linking of gardens and justice: Gardens and Justice have  been joined as figurae, genres and topoi in the classical writings of Virgil, in the Old Testament text of Genesis and the Garden of Eden, in Milton's epic of Paradise Lost, in Blackstone in Commentaries on the Laws of England, and not the last, in Neil Young's lyrics 'After the Garden', in his 2006 album Living with War. These and numerous other texts are peopled by figures who live at home, and others who depart from home. Together, and apart, they invite us to continue their genre of living and writing in a world of imperfection, suffering and violence, while  maintaining  other possibilities and other beginnings. The AFLJ invited articles which investigated the use of garden narratives, whether in jurisprudential writings, in film, in literary works, in political theory, or postcolonial theory, amongst other disciplinary conventions and media. Amongst the numerous questions which could be pursued, we posed the following: How do garden narratives and their figures structure an understanding of Justice, and for what purposes have  gardens and  justice been linked in national and international law? Are gardens our images of utopia, heaven, peace, or simply a homecoming from the deserts of life? Do gardens help us understand nations and territory? Are gardens ever secular? Are there historic forms of governance encoded in garden narratives?  In what ways  do Justice narratives in the 21st century understand  the figure who leaves the garden  as  having  a persona as stranger, serf, refugee or simply human, or not-human?

    The essay studies the introduction and use of audio-visual media in contemporary Swedish courtroom praxis and how this affects social interaction and the constitution of judicial space. The background to the study is the increasing use of video technology in law courts during the last decennium, and in particular the reformed trial code regulating court proceedings introduced in Sweden in 2008. The reform is called A Modern Trial (En modernare raättegång, Proposition 2004/05:131). An important innovation is that testimonies in lower level court proceedings now are video recorded and, in case of an appeal trial, then are screened in the appellate court. The study of social interaction and the constitution of judicial space in the essay is based in part on an ethnographic study of the Stockholm appellate court(Svea hovraätt) conducted in the fall 2010; in part on a study of the preparatory works to the legal reform; and in part on research on how media technology affects social interaction and the constitution of space and place.

    Abstract [en]

    The article discusses fashion advertising as a means to access and understand contemporary social imaginary significations of the body politic, focusing on an advertising for Louis Vuitton. The article suggest that one can read advertising as a form of continuous, running commentary that society makes of itself, and through which one can unearth the social imaginary. The article finds a plethora of meanings in the selected advertising for Louis Vuitton, but the central finding is that the fashion advertising represents community as an absence of community; in other words as a deficit that the brand somehow is able to rectify.

    Abstract [en]

    This article argues against the view that Roman law consciously resisted or even rejected the philosophical approach found in Greek thought and that it conceived and pursued legal scholarship in an exclusively practical and pragmatic fashion. In opposition to this view, this article maintains that the non-theoretical nature of Roman law is a fiction and part of an ideology, produced in order to disguise its ideological practices and to hide the mechanics of its workings. Not only do the classical Roman jurists (iuris consulti, iuris prudentes) discuss the nature and sources of law, they also engage in theorising law. Furthermore, in contrast to traditional commentary on Roman law, which tends to view theoretical approaches to law as not having a creative function in shaping the law, this article considers theoretical reflection a productive activity. However, theory implies not only philosophical reflection, but also an awareness and interest in the rhetorical and performative aspects of language. The article tries to show that in reading and interpreting statutes and cases, the Roman jurists are working with—but also resisting—the rhetorical and tropological dimensions of language, and that such a resistance to reading law is constitutive of legal theory. The article also suggests that this reading practice has certain affinities with cartographic practice.

    The modern legal courtroom is a peculiar place. Like the theatre it is a space open for many kinds of drama, verbal re-enactments of events and forced resolutions of human conflicts. There are often strong emotions at play in the courtroom: desire and love, jealousy and anger, but also sadness and remorse, fear and suffering. These emotions are controlled and tempered by the physical design of the courtroom, by legal procedure and the rule-bound rationality of law, but also by the serious attitude of the judge(s) and lay judges. Although in legal proceedings the parties are restrained from giving voice to emotions, in reality feelings and affects show through: in glances, timber of voice, flushes, crying, laughter, smell of sweat. Expressions of emotion and affect may be involuntary or staged, but in either case they are very much part of what is said and done in the courtroom. However, in the legal representation of court proceedings - in the transcripts and the rulings - these human emotions and affects become invisible, the emotions have been filtered away or have sunk to the bottom of legal space. In my essay I explore the peculiar emotive social space constructed and enacted in the courtroom, in particular the ambiguous attitude towards human emotions in law: on the one hand as disturbing and dangerous, and on the other as the true basis of human character and social conflict. The study is based on an ethnographic study of the lower level court in Stockholm (Stockholms tingsrätt) and forms part of a larger study on "Legal Spaces. The construction and representation of legal spaces in law, literature and political philosophy.

    “För ingen älskar budbäraren som kommer med dåliga nyheter” 

    Denna versrad kommer från Sofokles tragedi Antigone, uttalad av en budbärare. Men kanske borde man säga budbäraren, för i antik grekisk teater är budbäraren ofta en central figur som har en viktig roll att spela i den dramatiska handlingen. Det är ofta en underordnad person, som en väktare eller en herde, vars uppgift är att ge en fullständig och sanningsenlig redogörelse för vad som har hänt utanför scenen. I Sofokles Antigone beskriver budbäraren hur någon har brutit mot Kreons, Thebes härskare, förbud att begrava Polyneikes, Oidipus son och Antigones syster. I dramat gör de ”dåliga nyheterna” Kreon rasande och han hotar att straffa budbäraren om han inte hittar gärningsmannen. 

    Vetenskapen varnade oss redan i slutet av 1970-talet för att den omfattande användningen av fossil energi skulle leda till global uppvärmning, vilket i sin tur skulle orsaka en förändring av klimatet på ett sätt som radikalt förändrar livsvillkoren på planeten. Sedan dess har den vetenskapliga kunskapen vuxit om effekterna av en ökad koncentration av växthusgaser i atmosfären. I dag råder det inget tvivel om att klimatkrisen är ett hot mot civilisationens överlevnad. Allra värst drabbade är fattiga samhällen som i mycket liten utsträckning bidragit till utsläppen av växthusgaser.

    Vetenskapssamfundet har inte bara mobiliserats – och mobiliserat sig – för att producera kunskap om antropogen klimatförändring, den har också tagit på sig att kommunicera denna kunskap till politiker och beslutsfattare. Kanske trodde vetenskapssamfundet att det skulle räcka med att producera vetenskaplig kunskap och att ge en sanningsenlig redogörelse av denna kunskap för att få världens politiker och makthavare att agera. Det var i så fall naivt. Det politiska och ekonomiska ledarskapet har i bästa fall givit en läpparnas bekännelsetill de massiva vetenskapliga bevisen på att det är nödvändigt att drastiskt minska användningen av fossila bränslen och inom en snar framtid helt fasa ut dom. 

    Verkligheten är att det har skett en ständigt ökande produktion och användning av fossila bränslen. Det har genererats mer koldioxid från förbränning av fossila bränslen efter 1990, det år som FN:s klimatpanel IPCC presenterade sin första rapport, än från när industrialiseringen startade på 1800-talet fram till 1990. Men vetenskapssamfundet har inte bara funnit att deras budskap ignoreras, utan också att såväl klimatforskare som de vetenskapliga bevisen ifrågasätts av lobbyister från fossilindustrin och av folkvalda politiker. Antalet angrepp påenskilda forskare och vetenskapliga institutioner som kommunicerar etablerad kunskap om klimatförändring är otaliga.

    Det är mot bakgrund av detta ofantliga – obegripliga – svek från politiker och andra makthavare, som man ska förstå det upprop till uppror som den då nybildade aktivist-gruppen Extinction Rebellion (XR) deklarerade utanför det brittiska parlament i oktober 2018:

    "Vi deklarerar härmed att det sociala kontraktets band är ogiltiga och av intet värde, att regeringen har gjort dessa ogiltiga genom sin fortsatta underlåtenhet att agera på ett ansvarsfullt sätt. Vi uppmanar varje principfast och fredlig medborgare att göra uppror med oss."

    Det slags uppror som XR uppmanar till är helt fredligt, alltså ingen stormning av riksdagshus eller angrepp på politiker. Den övergripande strategin är att skapa uppmärksamhet om klimatfrågan genom fredliga demonstrationer och civil olydnad. Precis som i samband med kvinnors kamp för rösträtt runtom i Europa och medborgarrättsrörelsen i USA, så används civil olydnad som ett medel för att kräva att etablerade demokratiska och rättsliga principer omsätts i praktiken. I det ena fallet deklarationer om alla människors lika värde, i det andra enhållbar utveckling som leder till en god miljö för nuvarande och kommande generationer. 

    XR har tre krav: Tala klarspråk om klimatkrisen; Agera nu (inte 2030, 2035 eller 2045); Verka för en deltagande och inkluderande demokrati, rättvis omställning och transparens. De tre kraven kan tyckas ganska självklara i en liberal demokrati som hyllar förnuft och vetenskap. Men precis som när suffragetter och medborgarrättsaktivister krävde vad somborde vara en självklarhet i ett demokratiskt samhälle, så möts fredliga klimataktivister av en tilltagande repression från ordningsmakt och rättsväsende, och populistiska politiker utmålar dem som ett ”hot” – oklart mot vad. Lika litet som att ignorera eller misstänklig-göra klimatvetenskapen är en framgångsrik strategi för att lösa klimatkrisen, så är det inte meningsfyllt att kriminalisera fredliga aktivister som kämpar för en god miljö för nuvarande och kommande generationer. Aktivister kommer inte att sluta protestera mot politikernas klimatsvek för att man utdömer hårdare straff för fredliga protester. Tvärtom, i takt med att klimatkrisens effekter blir alltmer påtagliga kommer protesterna att tillta

    Abstract [en]

    The article explores the use of civil disobedience and non-violent direct action (NVDA) as a strategy and method in climate activism in Sweden, with a particular focus on the group Extinction Rebellion (XR). The article describes and analyzes a number of XR actions carried out in 2019-2022, with a focus on meaning-making practices. The uses of civil disobedience and NVDA are presented within a historical, cultural and social context; the question of the role and legitimacy of civil disobedience in democratic societies is discussed. 

    XR has civil disobedience and NVDA as central strategy and in this way the group has put these protest methods in focus, and after each major action there is a need to both explain and justify their use. This is more noticeable in a Swedish cultural context that is characterized by consensus and a stigmatization of disobedience. This relationship in turn affects the planning and execution of disobedient and disruptive protest actions in Sweden. The article explores how activists in XR Sweden relate to this specific cultural context and how they try to influence it; hence XR Sweden works not only to influence those in power and public opinion regarding the climate crisis, but also on the possibilities and forms of civil political protests. 

    The article is based on participant observation. These began in the spring of 2019 and are still ongoing. The study has an anthropological perspective, with an emphasis on semiotics and hermeneutics.

    This article contains an interview with professor Linda Nochlin, Department of History of Art, Yale University. The interview was made in New Haven, Connecticut, on September 24, 1991. Professor Nochlin responds to questions on her published works, and in particular on her essay "Why have there been no Great Women Artists?” (1971). She discusses the position of feminism within the academic institution, her own position within the same institution, and her understanding of the documentary status of her essays. She reflects on critique she has received for her 1971 essay, on sources for the same essay, and on her present and future projects. Professor Nochlin also addresses the questions of how different discourses interact and how painting becomes an integral part of the social construction of reality.

    The article describes and analyses how the climate activist group Extinction Rebellion (XR) Sweden makes use of art as part of nonviolent direct actions, a form of action which often is referred to as artivism. The article is based on direct observations of actions, documented online chats, interviews with participants, and content analysis of films, photographs and social media posts. The artivist actions were performed in Stockholm in 2020-2022. The interviews were made in the autumn 2022. The first part of the article is descriptive, presenting a series of artivist actions performed by the XR group. There is also a critical and historical discussion of politically engaged art and the use of art in activism. The second part of the article consists of a thematic analysis of the interview material. The article argues that artivism is import- ant both as a means of communication and for the internal culture in the activist group. As a form of meaning-making, artistic creation challenges the ready-made framing of political issues. The artivist performance is a form of place-making, temporarily transforming the meaning of public space, set- ting the stage for a carnivalesque where climate activists can appear as Fossil Fuel Industry executives, openly revealing disinformation and Greenwashing campaigns. Artivist action constitutes a form of aesthetics of resistance, chal- lenging hegemonic ideological representation. Many of the artivist actions performed by the XR group were satirical, where humour plays an important part. Humour is also important in other ways, to keep up the spirit and en- gagement of the activists, and to defuse possible tension with bystanders and representatives of law enforcement.

    Abstract [en]

    The subject of this article is to investigate the notion and status of public discourse in contemporary media. The article opens with a reading of the trope the ’open’ (das Offene) in Rainer Maria Rilke’s eighth Duineser Elegie and then discusses the meanings given to openess and public (Öffentlich, Öffentlichkeit) in the academic discourses of law, philoso- phy, political theory, and sociology. However, the principal focus of the article is on the artistic and political interventions by two Austrian artists, Otto Mittmannsgruber and Martin Strauß, made in commercialized public spaces in Austria and Germany during the years 1995-2004. Their artistic works directly address issues of power and public dis- course, and effect both a questioning of unilinear mass media communication and a politicization of commercialized public space. In the article it is argued that the interven- tions of Mittmannsgruber and Strauß in commercial mass media make strikingly visible the simultaneously open and closed nature of contemporary public discourse.
