    Abstract [sv]

    Studien omfattar en analys av innebörd och funktion hos det s.k. fastighets­skyddet i fastighetsbildningslagen 5 kap. 8 §. Syftet är att undersöka villkorets relevans idag med hänsyn till den samhälls- och rättsutveckling som skett sedan mitten av 1900-talet. Analysen visar att de motiv och argument som låg bakom fastighetsskyddets införande inte längre är av betydelse. Detta följer bl.a. av en radikalt förändrad jordbrukspolitik, förändrade företags­strukturer inom jordbruket, samt genomslaget av den s.k. proportionalitetsprincipen i svensk fastighetsrätt. Vid en ev. översyn av fastighetsbildningslagen föreslås därför fastighets­skyddet i sin nuvarande utformning istället ersättas av ett väsentlighetsvillkor, vilket skulle formalisera och tydliggöra kopplingen till den i rättspraxis gällande proportionalitetsprincipen.

    Abstract [sv]

    This thesis deals with the legal procedures indicated forchanges in land-related rights, i.e. land use planning andproperty acquisitions. The rules of procedure in this field oflaw are extensive and complicated.

    As a first step, the rules of procedure are structured intoa number of procedural types: administrative, cadastral andjudicial. The procedural characteristics and the substantivelegal character of the decisions are clarified andcompared.

    In a second step an institutional perspective is adopted,based on economic theory. The different types of procedure areperceived as alternative institutional solutions to the problemof transaction costs in transformations of land-related rightstructures. An economic analysis is made of the transactioncosts arising in the different types of procedure in connectionwith, respectively, permissibility assessment and propertyacquisition assessment.

    The administrative procedures present distinct comparativeadvantages in the assessment of permissibility questions, e.g.utility concessions or permits for environmentally hazardousactivity. In these questions, an extensive, heterogeneouscollective of individuals is made subject to external effects.Those effects are divided into smaller value fragments. Throughthe publicity and ready availability of the administrativeprocedures, coupled with the system of politicalaccountability, important information about the preferences ofthe collective concerned can be produced and made to form thebasis of the decision.

    The cadastral and judicial procedures present comparativeadvantages in connection with property acquisition assessments,such as compulsory purchase of land or exaction of utilityeasements. For the limited collective of individuals involved,the right of negotiating and concluding agreements willeffectively utilise the high degree of information and thestronger economic incentives for action. The negotiation phasebecomes a low-cost procedure which at the same time acts as aselective mechanism for transactions not requiring the coerciveand more expensive procedure of official assessment. Theself-containment of cadastral and judicial procedures and theirisolation from political influences benefit the quality andcontrol of the documentation on which decisions arefounded.

    Abstract [en]

    Land development involves many different assessments, decisions and judgements, and the institutional designs of these rules of procedure exhibit a variation of different structures. During legislative processes it is often stated by the law-making bodies that efficiency is an important aim and motive in the establishment of new or revised review procedures. Prevalent theoretical models concerning institutional development and change can, however, be classified into two opposing traditions depending on whether they perceive legislation as allocative (value-enhancing) or redistributive in nature.

    The aim of this article is to present some existing theories on institutional development and by two case studies, concerning legal reforms in Swedish legislation on land development, evaluate the explanatory and predictive capacity of these theories. The results and analysis indicate that both theoretical traditions have explanatory value and that the concept of path dependence is an important complementary factor.

    Studien och redogörelsen syftar till att illustrera hur utvecklingen av en by på landsbygden – i detta fall Lågarö i Rådmansö socken, Norrtälje kommun – kan beskrivas och analyseras med hjälp av den information som finns Lantmäteriets webbtjänst Historiska kartor, t.ex. geometriska ägomätningar, storskifte, laga skifte, häradsekonomiska kartan, nyare ekonomiska kartor samt nutida fastighetsregister med tillhörande digital registerkarta.

    Studien visar på dels stora förändringar avseende bebyggelse, infrastruktur samt, inte minst nedläggningen av jordbruksmark som omvandlats till tomter för fritidsbebyggelse under 1960- och 1970-talen. Samtidigt ger materialet belägg för att fastighets- och bebyggelsestrukturer samt markanvändningar har lång beständighet över tiden, något som är särskilt framträdande på landsbygden. Grunddragen från laga skiftet 1842 är fortfarande fullt synliga i dagens registerkarta.

    Materialet är i första hand avsett för utbildningsändamål, men utgör även en dokumentation av utvecklingen rörande markanvändning och fastighetsstruktur på lokal nivå såväl samtidigt som den speglar den allmänna utvecklingen i Mellansverige på ett generellt plan.

    Abstract [en]

    Over time, different models for representing legal features of real property rights have been developed as analytical tools. The purpose of this paper is to review and evaluate some of the existing models, and to develop certain extensions for representations and analyses of dynamic real property rights transformations. The Core Entities Model – which emphasizes relationships between subject (person), right, and object (land) – proves to be significant for analysing transformations of owner/right holder and territorial division, but has shortcomings in representing transformations of the rights’ content and extent, e.g. the granting of a building permit. By combining the static Core Entities Model with features from dynamic models, these difficulties can be overcome to some degree.

    According to standard economic theory, private property rights in land are considered superior to alternative institutional choices, such as common property or open access.

    This article investigates the existence of differing property rights regimes in the field of Swedish real property law. The economic implications of the different institutional arrangements are examined, and support is found for varying property rights regimes, depending on physical and technical aspects of the land uses in question. In particular, when a certain land use presents economies of scale, common property rights can serve to reduce transaction costs.

    Abstract [en]

    The article analyses the economic and legal choice between 3D property formation and other property rights alternatives to accommodate needs for multiple uses of and access to three-dimensionally defined spaces.

    An overview of 3D property rights alternatives in Sweden is presented, and a closer comparison made between easements and 3D property formation with regard to transaction costs. Two case studies show that the choice between different 3D property rights alternatives may in practice depend on features in completely different parts of the real property law system.

    Abstract [en]

    Management of roads and the institutional solution chosen is dependent on a number of factors such as, regulatory tradition, and roadnetwork scale. It is likely that some solutions are more efficient than others,and this article compares and analyses Danish and Swedish institutional solutions regarding road management. The aim is to explore and briefly evaluate the systems in terms of institutional efficiency. The hypothesis is that, efficient institutions have a better ability for survival in the politicalprocesses. It is observed that the chosen solutions on national and municipallevel are much alike, and therefore appear efficient. However, for common private roads, the institutional designs are very different, and seem to bebased on two diametrically contrasting views on how to govern this kind of roads.

    Abstract [en]

    In the 2009 EALD Symposium, a presentation and succeeding publication (Ekbäck and Kalbro 2011), identified situations where negative value effects for property owners, gener-ated by time-consuming infrastructure planning processes, were in conflict with Sweden’s commitments under the European Convention for the Protection of Human Rights and Fundamental Freedoms. The publication ultimately triggered amendments in the legislation on planning, acquisition and compensation for national roads and railroads. In the present paper, new situations are identified where again the Convention’s articles for protection of property and the right to a fair trial may be violated. The topic analysed and discussed concerns municipal planning for development of the built environment, resulting in planning blight, i.e. a reduction of property values in a particular area resulting from expected or possible future development or restriction of development. The particulars of a case study are compared to the standard planning model and the generic situation where the proposed land use leads to a local depreciation of property values compared to current land use.

    Abstract [sv]

    År 1932 inrättades den första professuren inom det fastighetstekniska ämnesområdetvid KTH. Den forskning som under de följande 90 åren bedrivits ochpublicerats vid KTH inom ämnet fastighetsteknik-fastighetsrätt har hittills intedokumenterats och analyserats i ett sammanhang.

    Syftet med denna forskningsöversikt är att inventera, dokumentera och systematiseraden fastighetstekniska och fastighetsrättsliga forskning som bedrivits ochpublicerats vid avdelningen för fastighetsvetenskap (och motsvarande äldreorganisatoriska enheter), vid KTH. I rapporten ges även en översiktlig redogörelseför den formella tillkomsten och utvecklingen av ämnesområdet vid KTH.

    Som underlag för rapporten har en extensiv litteratursökning genomförts,innefattande den forskning som publicerats inom ämnesområdet, vilken redovisasi en publikationslista som finns i rapportens bilaga.

    En tematisk och tidsmässig klassificering av olika forskningsinriktningar från1930-talet fram till idag resulterar i följande indelning:

    • Jord- och skogsbruk, perioden 1930 – 1970

    • Fritidsbebyggelse och tätortstillväxt, perioden 1960 – 1990

    • Markexploatering, perioden 1980 – fortgående

    • Nya rättighets- och upplåtelseformer m.m., perioden 1990 – fortgående

    • Historiskt inriktad forskning, hela perioden

    I rapporten redogörs även för publiceringsformer samt den internationalisering avämnesområde och forskningsinriktningar som skett från 1970-talet och framåt.

    Av den tematiska redovisningen och analysen framgår att det fastighetstekniskafastighetsrättsligaämnesområdet har genomgått en kontinuerlig utveckling övertid, tydligt kopplad till de förändrade markanvändningsbehov som samhällsutvecklingeni övrigt skapat. Samtidigt finns en bestående kärna i ämnet somgenomsyrat forskningen oberoende av tidsepok och inriktning. Det genom tidernaförenande temat är fastigheten i en eller annan form samt dess funktionellakoppling till den omgivande tekniska infrastrukturen.

    I övrigt innehåller rapporten en kortare biografisk presentation av innehavarna av professurerna i fastighetsteknik respektive fastighets-, byggnads- och värderingsrätt.

    Abstract [en]

    Digitalization and automation of different elements of the land development process are frequent and highlighted phenomena in both Finland and Sweden. Several projects focus on standardization of spatial data, electronic transactions of real property, physical plans in digital format, etc. The focus of most projects is on technical and organizational aspects of these potential developments. Legal features do occur, but are mostly devoted to protection of personal data and privacy. The emphasis in this study is on legal structures and relationships in real property law, applicable in property formation processes. The objective is to compare the legal system for property formation in Finland and Sweden concerning potentials and obstructions for digi-talization and automation of the legal process for examination and adjudication. Apart from some minor obstacles, the findings indicate that the Swedish legal system for property for-mation, to a larger degree, suffers from a complex interconnection between the legislation on real property formation and the public regulation of permitted land uses. This intercon-nection is not present in all processes in the Finnish system, which will simplify the road towards digitalization of the property formation process in Finland.

    Abstract [en]

    This paper aims to elucidate the sliding scale between usufruct and ownership by applyinga property rights framework to three Swedish forms of tenure in multifamily housing. The frameworkdeconstructs the bundles of rights of rental, tenant-ownership and ownership to highlightcommonalities and differences connected to the right to use and exclude, the right to transfer andthe right to the value. It is concluded that the three tenure forms have many traits in common butthat there are distinct differences in some areas, most notably in connection to the right to the value.The property rights framework applied in the study may be applicable also on a general level as amethod to analyze and compare tenures of different types in different countries. Further, ways toimprove the framework and cover more facets of outcomes of property rights patterns are suggested.
