Vid ändringar av ändamål i gemensamhetsanläggningar behöver man enligt svensklag ofta genomgå en omprövning, en både tidskrävande och kostnadsdrivandeprocess för samfällighetsföreningar. Lantmäterimyndigheten saknar idag entillsynsplikt för att kontrollera att anläggningsbesluten efterlevs, vilket kan bidra till attde inte följs lagenligt.

Denna studie undersöker i vilken utsträckning anläggningsbeslut efterlevs blandsamfällighetsföreningar vid ändring av ändamål i gemensamhetsanläggningar. Arbetetutfördes med särskilt fokus på införande av laddinfrastruktur och FNI-reformen. Genomen litteratur- och arkivstudie som kompletterades av intervjuer medsamfällighetsföreningar och experter inom området analyserades anledningarna tillvarför anläggningsbesluten frångås. Vidare analyseras även regelverkets påverkanoch verktyg som kan underlätta efterlevnad i framtiden.

Intervjuerna indikerade att många samfällighetsföreningar väljer att frångålagstiftningens krav på omprövning vid förändring av anläggningsändamål. Bristandekunskap, höga kostnader och tidskrävande processer resulterades vara dehuvudsakliga anledningarna till varför samfällighetsföreningar inte ansöker omlantmäteriförrättning. Samfällighetsföreningar har olika kreativa lösningar på hur mankommer runt lagstiftningen. De potentiella verktygen för att öka efterlevnaden handlarom att åtgärda de faktorer som förhindrar efterlevnad. Att minska kostnader och kortaner handläggningstiderna genom att tillämpa en övergripande och mer flexibel lagstiftning.

Abstract [en]

In Sweden, changes in joint facilities are often required to go through officialprocedures. This often results in time-consuming and expensive processes forcooperative associations. Despite these legal requirements, there’s no regulatorysupervision from the Swedish Cadastral Authority that ensures that the decisions onjoint facilities are adhered to. This can contribute to the fact that some cooperativeassociations choose to not follow these decisions made under the Joint Facilities Act.

This study investigates to what extent the decisions under the Joint Facilites Act arenot adhered to when the intended use of the joint facility changes. The main focus liesin the implementation of charging infrastructure and implementation of property-nearwaste collection (FNI – reformen). This study is based on a literature review andarchival study, complemented with interviews with the cooperative associations andexperts in this field. The interviews contributed to a broader perspective on the reasonswhy these cooperative associations choose to deviate from the regulations.Furthermore, the effect of the law is analyzed and what instruments could possibly helpthe associations adhere to the decisions under the Joint facilities Act are investigated.

The interviews indicate that many of the cooperative associations have chosen toimplement charging infrastructure without modifying the decisions that are made underthe Joint Facilites Act. Lack of knowledge, time-consuming and expensive processesseem to be the main reasons as to why they do not follow the decisions. Cooperativeassociations have a lot of interesting and creative solutions to bypass the currentregulations. The potential tools to ensure compliance include ways to address thecurrent factors that hinder the associations from following the current regulations.These tools include lowering costs and shortening the process times, which is possibleby developing overarching and flexible legislation.
