I Sverige har diskussionen om budgivningsprocessen på privatbostadsmarknaden blivit ett återkommande samtalsämne där argument för och emot ett eventuellt införande av bindande bud framkommer mer och mer frekvent. Den svenska tillsynsmyndigheten Fastighetsmäklarinspektionen (FMI) anförde i maj 2024 att tillsynen behöver ses över och att det krävs striktare reglering samt ett införande av bindande bud på den svenska bostadsmarknaden. Ett år senare har något införande inte skett och regeringen har inte handlat för att börja implementera vad tillsynsmyndigheten eftersträvar.

För att kunna göra ett konkret ställningstagande kring ett införande av bindande bud har en kvalitativ komparativ metod valts, med intervjuer med fastighetsmäklare och tillsynsmyndigheterna i Sverige och Norge. Sekundärdata kommer att tas hänsyn till i form av artiklar för att också uppmärksamma allmänhetens perspektiv.

De fastighetsmäklare som tillfrågats har gett insiktsfulla svar och det har identifierats en rad meningsskiljaktigheter. Ytterst intressant är dock att majoriteten av både den intervjuade populationen och de branschmedlemmar som uttryckt sig i media motsätter sig idén av ett införande av bindande bud på den svenska bostadsmarknaden.

Abstract [en]

In Sweden, the discussion regarding the bidding process in the private housing market has become a recurring subject of debate, with arguments both for and against the potential introduction of binding bids appearing with increasing frequency. In May 2024, the Swedish supervisory authority Fastighetsmäklarinspektionen (FMI) asserted that regulatory oversight needs to be reviewed and that stricter regulation, including the implementation of binding bids, is required in the Swedish housing market. One year later, no such implementation has occurred, and the government has yet to take action to begin enforcing the measures proposed by FMI.

In order to establish a sound and empirically grounded position on the issue, a qualitative comparative method was implemented, incorporating interviews with real estate agents and supervisory authorities in both Sweden and Norway. Secondary data, including articles reflecting public opinion, has also been considered to capture the broader societal perspective.

The interviewed real estate agents provided insightful responses, revealing a range of differing opinions. Notably, however, the majority of both the respondents and industry representatives who have voiced their views in the media oppose the idea of introducing binding bids in the Swedish housing market.
